These websites are operated and maintained by the Southern California Association of Governments (referred to as “SCAG” herein). By using SCAG’s websites, you signify your agreement to these terms of use and SCAG’s Privacy Policy for Collection, Management and Storage of Personal Information. If you do not agree to these terms of use, please do not use these sites. You acknowledge that use of SCAG’s websites is at the user’s sole risk.

1. Restrictions on Use of Materials

Materials and information in these websites are provided as a public service. Generally, most of these materials and information were generated, compiled, or assembled at public expense and are freely available for public use in accordance with the California Public Records Act (California Government Code section 6250 et. seq.), provided you credit SCAG when using these materials and information.

Some of the materials and information in these sites, such as the Third Party Materials addressed below and select materials bearing a copyright notice, may not be used for any purpose. Use or modification of these materials or information for commercial or profit making purposes is prohibited and may violate the copyrights and/or other proprietary rights of SCAG or third parties. 2. Third Party Materials

Some materials and information used on SCAG’s websites was generated by third parties who have consented to SCAG’s use or placement of such materials on these sites. These materials are owned by those parties. Use of these Third Party Materials for any purpose is prohibited. Persons seeking to use or modify Third Party Materials for any purpose should contact the owner of such materials directly.

These materials include icons and /or graphics used in links to other organizations’ sites, descriptions and some general content.

3. Disclaimer of Liability

SCAG, including its governing board (the Regional Council), members, employees and agents, shall not be held liable for any improper or incorrect use of the materials or information described and/or contained in these sites and assumes no responsibility for user’s use of them. In no event shall SCAG be liable for any direct, indirect, incidental, special, punitive, exemplary or consequential damages (including, but not limited to any damages for anticipated profits, loss of revenue, economic loss, loss of data, costs of procurement of substitute goods or services; loss of use of equipment, or interruption of business) arising in any way out of the use of these sites or materials and information herein, even if advised of the possibility of such damage. This disclaimer of liability applies to any damages or injury, including but not limited to those caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, under any theory of liability whether for breach of contract, tortious behavior, negligence or under any other cause of action.

SCAG strives to provide the most current information in a timely fashion. However, materials and information including maps on these websites are produced in whole or in part from a variety of sources. SCAG is not responsible for inaccuracies in data from other sources.

6. Disclaimer of Hypertext Links

SCAG is not responsible for the contents of any off-site materials referenced. The user specifically acknowledges that SCAG is not liable for the defamatory, offensive or illegal conduct of other users, links or third parties, and that the risk of injury from the foregoing rests entirely with the user.

Links from these sites to other sites on the World Wide Web do not constitute an endorsement from SCAG. These links are provided for informational purposes only. It is the responsibility of the user to evaluate the content and usefulness of materials or information obtained from other sites.

7. Indemnification

To the extent permitted by applicable law, user agrees to defend, indemnify and hold harmless, SCAG and its Regional Council members, directors, officers, employees and agents from and against all claims, liabilities and expenses, including attorneys’ fees, arising out of the user’s use of these sites or materials and information contained herein.

8. Choice of Law/Interpretation

These terms of use, including the legal disclaimers and indemnification, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. If any provision of these terms of use is declared unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the other terms and shall not affect the validity and enforceability of the remaining provisions. Venue for any actions arising from the use of these websites shall be Los Angeles County.

9. Use of the Logos of the Southern California Association of Governments

The SCAG logo and ancillary logos are official symbols of SCAG and are used for official SCAG business. There are limited circumstances which are reviewed on a case-by-case basis when third parties may be granted permission to use SCAG logos.

The SCAG logos may not be used without permission. Such logo is used by SCAG to indicate official information and/or official agency publications. If it is used by other entities, it could be construed as an endorsement of a product or process, and SCAG cannot provide such endorsements. The SCAG logo should also not appear on any website other than ones hosted and maintained by SCAG. Occasionally, SCAG’s logo is used on websites, banners, or posters for workshops, meetings, or conferences where SCAG is a sponsor or co-sponsor. Or there may be another reason for the SCAG logo to appear on project-related items. Those uses require approval by SCAG’s Media and Public Affairs Department before a product is created. Draft versions of such documents will need to go through the approval/review and sign-off process.

Requests to use a SCAG logo must be submitted in writing by sending an email to the Media and Public Affairs Department Your request must include the purpose of the proposed use of the SCAG logo, how the logo is proposed to appear, the scope of distribution and your contact information. Requests may also be emailed to contactus@scag.ca.gov or mailed to SCAG, Media and Public Affairs, 900 Wilshire Blvd., Ste. 1700, Los Angeles, CA 90017.
